Distance Sales Agreement

Buyer: the person or organization that creates an account on Kitisel and whose details appear on the checkout page. The buyer's name, address, email and phone are those provided at checkout.
2. Subject
This agreement sets out the rights and obligations of the parties, under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, for the sale and performance of the Kitisel software service (SaaS) subscription purchased electronically by the Buyer at https://kitisel.com.
3. Main features and price
The scope of the service (monthly articles, number of sites, update suggestions, tracked keywords, team members and other features), the chosen plan, billing interval (monthly / yearly) and the total price including taxes are as shown on the checkout page and the Pricing page. Prices are in US dollars (USD). If your card uses another currency, your bank sets the exchange rate.
4. Payment
Payment is made by credit or debit card through PayTR (PayTR Ödeme ve Elektronik Para Kuruluşu A.Ş.), or by bank transfer to the Seller's bank account shown on the checkout page. The Seller does not see or store card details. Each payment opens the service for the chosen period (one month or one year); there are no automatic charges. The Seller sends the Buyer a renewal reminder before the period ends; if the Buyer does not renew, nothing is charged for the next period. For bank transfers to the TRY account, the amount is calculated at the Central Bank of the Republic of Turkey selling rate at the time of the order and shown on the checkout page.
5. Delivery (performance)
The service is activated in the Buyer's account immediately after the payment is confirmed (for bank transfers, when the payment reaches the Seller's account) and is provided electronically at https://kitisel.com. There is no physical delivery.
6. Right of withdrawal
Under Article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly in an electronic environment. By confirming the payment, the Buyer agrees that performance starts immediately. Nevertheless, the Seller refunds the full first payment without conditions if requested within 14 days of the first payment. Details: Cancellation, Refund and Delivery Policy.
7. Cancellation
The Buyer can cancel the subscription at any time in the app or by writing to info@artiseltech.com. Cancellation takes effect at the end of the paid period and no fee is charged for the next period.
8. Obligations
The Seller provides the service in line with the Terms of Service. The Buyer uses the service lawfully and in line with the Terms of Service, connects only sites they are authorized to manage, and reviews published content.
9. Personal data
The Buyer's personal data is processed under the Privacy Policy and the KVKK Privacy Notice.
10. Disputes
Consumer arbitration committees at the Buyer's or Seller's place of residence have jurisdiction within the monetary limits announced each year by the Ministry of Trade, and consumer courts above those limits. If the Buyer is a merchant, the courts and enforcement offices of [Juridiction compétente] have jurisdiction.
11. Entry into force
The agreement is concluded when the Buyer reads and electronically accepts this agreement and the Pre-Information Form on the checkout page. A copy is sent to the Buyer's email address and kept by the Seller.
